  3. 甲方因乙方違反本合同的規(guī)定而受的損失,可在保證金中扣抵雙方協(xié)議數(shù)目,不足部分乙方必須在接到甲方付款通知后十天內(nèi)補(bǔ)足。Party A may deduct a negotiated amount of security deposit towards Payments of any actual damages Party A shall have incurred or suffered as a result of Party B’s breach of this Agreement.   3. 在乙方遵守本合同的條款及交付租金的前提下,如非中國(guó)法律特別規(guī)定,乙方有權(quán)于租賃期內(nèi)拒絕甲方或其他人騷擾而安靜享用出租房屋。

  Provided Party B paying the rent and performing and observing Party B’s terms and conditions herein contain shall peaceably hold and enjoy the leased property throughout the term of this Agreement without any interruption by Party A or any other person save and except as required by the law of the People’s Republic of China.

  4. 房屋基本設(shè)施和結(jié)構(gòu)(不包括乙方損壞的家私和器具)損壞時(shí),甲方有修繕的責(zé)任并承擔(dān)有關(guān)的費(fèi)用,并對(duì)其作定期修保。

  Party A is responsible for repairing and maintaining the basic facilities (excluding furniture and appliances damaged by Party B), the structure of the leased property and for bearing all costs related thereto.

  5. 甲方謹(jǐn)在此聲明及保證甲方為出租房屋的合法擁有人并有合法地位出租此房屋予乙方。就本合同及出租此房屋予以乙方之事,甲方已取得所有有關(guān)機(jī)構(gòu)的批準(zhǔn),包括政府批準(zhǔn)及抵押權(quán)人的同意(如適用)。甲方于本合同所做出的聲明及保證,如有錯(cuò)誤或違反者,甲方須就乙方因此而引致的任何損失、損害、支出及費(fèi)用做出全部補(bǔ)償。 Party A hereby represents and warrants that Party A is legal owner of the leased property and has the necessary legal capacity to lease the property to Party B. Party A has also obtained all the necessary authorizations from all relevant authorities in the People’s Republic of China in respect of this Agreement and the leasing of the property to Party B, including government approval and/or mortgagee consent (if applicable).

  Party A shall be liable to Keep Party B be fully indemnified against any costs, expenses, losses and damages incurred to suffered by Party B as a result of any breach of Party A’s representations of warranties herein(including but not limited to legal costs.

  六、乙方的'責(zé)任 Obligations of Party B:

  1. 乙方應(yīng)按合同的規(guī)定,按時(shí)支付租金,保證金及其它各項(xiàng)應(yīng)付費(fèi)用如水、電、煤、寬帶等費(fèi)用。 Party B shall promptly pay all rent, security deposit and other charges such as water, electricity, gas, ADSL, etc payable by it in accordance with the terms of this Agreement.

  2. 乙方經(jīng)甲方事先書面同意,可在承租用房?jī)?nèi)進(jìn)行裝修及添置設(shè)備。租賃期滿后恢復(fù)原狀或可正常出租狀態(tài)(正常損耗除外),并承擔(dān)其費(fèi)用,經(jīng)甲方驗(yàn)收認(rèn)可后歸還甲方。乙方在租賃結(jié)束交房時(shí)應(yīng)保持房屋清潔。

  Party B may, with the prior written consent of Party A, renovate and install additional facilities in the leased property. Upon expiry of the tenancy, the leased property shall be returned to Patty A in its original conditions of normal lease conditions(fair wear and tear excepted), and all expenses arising there from shall be borne by Party B. Party B shall keep the premise clean once returning it to Party A.

  3. 乙方應(yīng)愛(ài)護(hù)使用租賃的房屋,如因乙方的過(guò)失或過(guò)錯(cuò)致使房屋及設(shè)施受到損壞(正常損耗除外),乙方應(yīng)負(fù)賠償責(zé)任。 Party B shall treat the leased property with care. If, as a result of party B’s negligence or misconduct, the leased property and the related facilities suffer any damage (fair wear and tear exempt), Party B shall be responsible for compensating Party A for such damages.

  4. 乙方應(yīng)按本合同的約定合法使用租賃房屋,不得擅自改變使用性質(zhì),不應(yīng)存放中華人民共和國(guó)法律下所禁止的危險(xiǎn)的物品,如因此發(fā)生損害,乙方應(yīng)承擔(dān)全部責(zé)任。Party B shall use the leased property legally as agreed in this Agreement and may not change such use on its own. Party B shall not store any dangerous items which are prohibited by the laws in the People’s Republic of China in the leased property and shall be fully responsible for any damages or losses as a result thereof.

  5. 未經(jīng)甲方事先書面同意,乙方不得將承租的房屋轉(zhuǎn)租或分租給其他的第三方.

  Without Party A’s prior written consent, Party B may not assign the tenancy or sublet the leased property to a third party.

  七、違約處理Breach of Agreement:

  1. 甲、乙任何一方在未征得對(duì)方諒解的情況下,不履行本合同規(guī)定條款,導(dǎo)致本合同中途中止,則視為該方違約,雙方同意違約金為人民幣元整(¥ ),若違約金不足彌補(bǔ)無(wú)過(guò)錯(cuò)方之損失,則違約方還需就不足部分支付賠償金。 During the lease term, any party who fails to fulfill any article of this contract without the other party’s (¥party in breach should pay additional compensation to the other party.

  2.乙方有下列行為之一的,甲方有權(quán)終止本合同,收回出租房屋,并且保證金不予退還。

  a) 將承租的房屋擅自轉(zhuǎn)租

  Sublets the leased property to another person

  Alters the structure of the leased property without authorization or uses the leased property rather than for the purpose stated herein

  Fails s to pay rent without any reason for more than 15 days after the due date

  八、不可抗力 Force Majeure:

  若由于不可抗拒的自然災(zāi)害(包括但不限于火災(zāi)、洪水、地震、施工、敵對(duì)、瘟疫等行為等)

  (include, but not limited to, fires, flood, earth quakes, accidents, strikes, wars, insurrections, public enemy,pestilence etc).or actions that are not the result of Party B’s fault, Party B shall have the right to terminate this Agreement and prorated balance of all rents and management fees paid, as well as security deposit, shall be returned to Party B without any set-offs or deductions.

  九、適用法律Applicable Law:

  本合同的成立,其有效性,解釋,簽署和解決與其有關(guān)的一切糾紛均應(yīng)受中國(guó)法律的管轄并依據(jù)中國(guó)法律解釋。The formation of this Agreement, its validity, interpretation, execution and settlement of any disputes arising hereunder shall be governed by and construed in accordance with the laws of the People’s Republic of China.

  十、爭(zhēng)議的解決 Dispute Resolution:

  十一、其他 Others:

  1. 本合同附件是本合同不可分割的組成部分,具有同等法律效力。

  If this Agreement is unclear with respect to certain matters, the two parties shall discuss to resolve such ambiguities.

  this agreement of lease is made on this 16th day of december XX by and between:-

  mrs. ghazala waheed w/o abdul waheed, adult, r/o house no.***-*, dha, lahore cantt, (hereinafter to as the lessor of the one part).

  2. 租金按月為壹期支付;第一期租金于_______年_____月_____日以前付清;以后每期租金于每月的______日以前繳納(以匯出日為支付日,匯費(fèi)由匯出方承擔(dān)),先付后住, 甲方收到租金后予書面簽收。。

  3、如乙方逾期支付租金超過(guò)十個(gè)工作日,則每天以月租金的0.5%支付滯納金;如乙方逾期支付租金超過(guò)十五天,則視為乙方自動(dòng)退租,構(gòu)成違約,甲方有權(quán)收回房屋,并追究乙方違約責(zé)任。 In case the back payment is more than 10 work days, Party B will pay 0.5 percent of monthly rental as overdue fine every day, if the rental be paid 15 days overdue, Party A will deem that party B has quitted the lease and breach the contract. In this situation, Party A has the right to take back the premises and take actions against party B’s breach.

  五、押金 / Deposit

  1.為確保房屋及其附屬設(shè)施之安全與完好,及租賃期內(nèi)相關(guān)費(fèi)用之如期結(jié)算,乙方同意于月元整,甲方在收到押金后予以書面簽收。 Guarantying the safety and good conditions of the premises and attached facilities and account of

  receipt after receiving the deposit.

  2. 除合同另有約定外,甲方應(yīng)于租賃關(guān)系解除且乙方遷空、點(diǎn)清并付清所有應(yīng)付費(fèi)用后的當(dāng)天將押金全額無(wú)息退還乙方。

  Unless otherwise provided for by this contract, Party A will return full amount of the deposit without interest on the day when this contract expires and party B clears the premises and has paid all due rental and other expenses.

  3. 因乙方違反本合同的規(guī)定而產(chǎn)生的違約金、損壞賠償金和其它相關(guān)費(fèi)用,甲方可在押金中抵扣,不足部分乙方必須在接到甲方付款通知后十日內(nèi)補(bǔ)足。

  In case party B breaches this contract, party A has right to deduct the default fine, compensation for damage or any other expenses from the deposit. In case the deposit is not sufficient to cover such items, Party B should pay the insufficiency within ten days after receiving the written notice of payment from Party A.

  4. 因甲方原因?qū)е乱曳綗o(wú)法在租賃期內(nèi)正常租用該物業(yè),甲方應(yīng)立即全額無(wú)息退還押金予乙方,且乙方有權(quán)追究甲方的違約責(zé)任。

  If Party B can’t normally use the apartment because of Party A, Party A should return the deposit to Party B at once. And, Party B has the right to ask for the compensation from Party A.

  六、甲方義務(wù) / Obligations of Party A

  1.甲方須按時(shí)將房屋及附屬設(shè)施(詳見(jiàn)附件)交付乙方使用。

  Party A will provide the premises and attached facilities (see the appendix of furniture list for detail) on schedule to Party B for using.

  2. 房屋設(shè)施如因質(zhì)量原因、自然損耗、不可抗力或意外事件而受到損壞,甲方有修繕并承擔(dān)相關(guān)費(fèi)用的責(zé)任。如甲方未在兩周內(nèi)修復(fù)該損壞物,以致乙方無(wú)法正常使用房屋設(shè)施,乙方有權(quán)終止該合約,并要求退還押金。

  In case the premise and attached facilities are damaged by quality problems, natural damages or

  accidents, Party A will be responsible to repair and pay the relevant expenses. If Party A can’t repair the damaged facilities in two weeks so that Party B can’t use the facilities normally, Party B has the right to terminate the contract and Party A must return the deposit.

  3. 甲方應(yīng)確保出租的房屋享有出租的權(quán)利,如租賃期內(nèi)該房屋發(fā)生所有權(quán)全部或部分轉(zhuǎn)移、設(shè)定他項(xiàng)物權(quán)或其他影響乙方權(quán)益的事件,甲方應(yīng)保證所有權(quán)人、他項(xiàng)權(quán)利人或其他影響乙方權(quán)益的`第三者能繼續(xù)遵守本合同所有條款,反之如乙方權(quán)益因此遭受損害,甲方應(yīng)負(fù)賠償責(zé)任。 Party A will guarantee the lease right of the premises. In case of occurrence of ownership transfer in whole or in part and other accidents affecting the right of lease by party B, .party A shallguarantee that the new owner, and other associated ,third parties shall be bound by the terms of this contract. Otherwise, Party A will be responsible to compensate party B’s losses.

  七、乙方義務(wù)/ Obligations of Party B

  1.乙方應(yīng)按合同的規(guī)定按時(shí)支付租金及押金。

  Party B will pay the rental and the deposit on time.

  2.乙方經(jīng)甲方同意,可在房屋內(nèi)添置設(shè)備。租賃期滿后,乙方將添置的設(shè)備搬走,并保證不影響房屋的完好及正常使用。

  Party B may add new facilities with Party A’s approval. When this contract expires, Party B may take away the added facilities without changing the good conditions of the premises for normal use.

  3.未經(jīng)甲方同意,乙方不得將承租的房屋轉(zhuǎn)租或分租,并愛(ài)護(hù)使用該房屋如因乙方過(guò)失或過(guò)錯(cuò)致使房屋及設(shè)施受損,乙方應(yīng)承擔(dān)賠償責(zé)任。

  Party B will not transfer the lease of the premises or sublet it without Party A’s approval and should take good care of the premises. Otherwise, Party B will be responsible to compensate any damages of the premises and attached facilities caused by its fault and negligence.

  4. 乙方應(yīng)按本合同規(guī)定合法使用該房屋,不得擅自改變使用性質(zhì)。乙方不得在該房屋內(nèi)存放危險(xiǎn)物品。否則,如該房屋及附屬設(shè)施因此受損,乙方應(yīng)承擔(dān)全部責(zé)任。

  Party B will use the premises lawfully according to this contract without changing the nature of the p

  remises and storing hazardous materials in it. Otherwise, Party B will be responsible for the damages caused by it.

  5.乙方應(yīng)承擔(dān)租賃期內(nèi)的水、電、煤氣、電話費(fèi)、收視費(fèi)、一切因?qū)嶋H使用而產(chǎn)生的費(fèi)用,并按單如期繳納。

  Party B will bear the cost of utilities such as telephone communications, water, electricity and gas on time during the lease term.

  八、合同終止及解除的規(guī)定/ Termination and dissolution of the contract

  1. 乙方在租賃期滿后如需續(xù)租,應(yīng)提前一個(gè)月通知甲方,由雙方另行協(xié)商續(xù)租事宜。在同等條件下乙方享有優(yōu)先續(xù)租權(quán)。

  Within one month before the contract expires, Party B will notify Party A if it intends to extend the lease. In this situation, two parties will discuss matters over the extension. Under the same terms Party B has the priority to lease the premises.

  2. 租賃期滿后,乙方應(yīng)將房屋交還甲方;任何滯留物,如未取得甲方諒解,均視為放棄,任憑甲方處置,乙方?jīng)Q無(wú)異議。

  When the lease term expires, Party B will return the premises and attached facilities to Party A. Any belongings left in it without Party A’s previous understanding will be deemed to be abandoned by Party

  B. In this situation, Party A has the right to dispose of it and Party A will raise no objection.

  3. 本合同一經(jīng)雙方簽字后立即生效;未經(jīng)雙方同意,不得任意終止,如有未盡事宜,甲、乙雙方可另行協(xié)商。

  This contract will be effective after being signed by both parties. Any party has no right to terminate this contract without another party’s agreement. Anything not covered in this contract will be discussed separately by both parties.

  九、違約及處理/ Breach of the contract

  1. 甲、乙雙方任何一方在未征得對(duì)方諒解的情況下,不履行本合同規(guī)定條款,導(dǎo)致本合同中途終止,則視為該方違約,雙方同意違約金為 元整,若違約金不足彌補(bǔ)無(wú)過(guò)錯(cuò)方之損失,則違約方還需就不足部分支付賠償金。

  During the lease term, any party who fails to fulfill any article of this contract without the other party’s understanding will be deemed to breach the contract. Both parties agree that the default fine will be RMB . In case the default fine is not sufficient to cover the loss suffered by the faultless party, the party in breach should pay additional compensation to the other party.

  2. 若雙方在執(zhí)行本合同或與本合同有關(guān)的事情時(shí)發(fā)生爭(zhēng)議,應(yīng)友好協(xié)商;協(xié)商不成,可向有管轄權(quán)的人民法院提起訴訟。

  Both parties will solve the disputes arising from execution of the contract or in connection with the contract through friendly consultation. In case the agreement cannot be reached, any party may summit the dispute to the court that has the jurisdiction over the matter.

  十、其他 / Miscellaneous

  1.本合同附件是本合同的有效組成部分,與本合同具有同等法律效力。

  Any annex is the integral part of this contract. The annex and this contract are equally valid.

  To be packed in new strong wooden case(s) suitable for long distance air/land transportation and well protected from dampness, moisture, shock, rust and rough handling. The Sellers shall be liable for any damage to the goods on account of improper packing and for any rust damage and break damage attributable to inadequate or improper protective measures taken by the Sellers, and in such case or cases any and all losses and / or expenses incurred in consequence thereof shall be borne by the Sellers. One full set of service and operation manuals concerned shall be enclosed in the case(s). The wood packaging the Seller used shall be fumigated and marked with “IPPC” on the surface of wood packaging.

  (12) 嘜頭:SHIPPING MARK:

  賣方應(yīng)在每件包裝上,用不褪色油墨清楚地標(biāo)刷件號(hào)、尺碼、毛重、凈重、“此端向上”、“小心輕放”、“切勿受潮”等字樣,并刷有下列嘜頭:

  On the surface of each package, the package number, measurements, gross weight, net weight, the lifting positions, such cautions as “THIS SIDE UP”, “HANDLE WITH CARE”,“KEEP AWAY FROM MOISTURE” and the following shipping mark:

  1. 正本空運(yùn)單(收貨人聯(lián)),標(biāo)明“運(yùn)費(fèi)已付”及嘜頭,買方為收貨人及通知方。

  Original Airway Bill (copy for Consignee) marked “freight prepaid” and shipping mark, consign to and notify the Buyer.

  2. 涵蓋1%合同金額的商業(yè)發(fā)票三正三副,注明合同號(hào)、嘜頭。

  Commercial invoice covering 1% of contract amount in 3 originals and 3 copies, indicating contract number, shipping mark.

  3. 裝箱單三正三副,注明毛、凈重、尺碼和所裝貨物的包裝形式及數(shù)量。

  Detailed Packing List in 3 originals and 3 copies indicating both gross and net weights, measurements and packing condition and quantity of each item packed.

  4. 賣方出具的質(zhì)量及數(shù)量證書正本三份。

  Certificate of quality and quantity issued by seller in 3 originals.

  5. 賣方出具的原產(chǎn)地證書一正一副。

  Certificate of origin in 1 original and 1 copy issued by Seller.

  6. 貨物裝運(yùn)后24小時(shí)內(nèi)賣方發(fā)給買方裝運(yùn)通知傳真復(fù)印件一份。

  Copy of fax from seller to the buyer advising the particulars of shipment within 24 hours after shipment is made.

  7. 保險(xiǎn)單或保險(xiǎn)證明一正一副,按照合同金額11%投保一切險(xiǎn)及戰(zhàn)爭(zhēng)險(xiǎn)。

  Insurance Policy or Certificate for 11% contract value, covering All Risks and War Risk in 1 original and 1 copy.

  8. 賣方聲明外包裝表面標(biāo)有IPPC標(biāo)識(shí)證書正本一份, 或賣方出具的非木質(zhì)包裝證明正本

  Seller’s Certificate in 1 original certifying IPPC has been marked on surface of the wooden cases / seller’s Certificate certifying no wood package is used in the shipment.

  (15) 裝運(yùn)通知:SHIPPING ADVICE:

  The Sellers shall fax to the Buyer the Readiness Notification one week before the goods to be shipped.

  賣方在發(fā)貨前一周物向買方傳真貨物備妥通知。

  The Sellers shall, immediately upon the completion of the loading of the goods in 24 hours, send the Buyers Air Waybill, Invoice and Packing list by fax.

  裝運(yùn)通知:賣方應(yīng)在貨物裝運(yùn)完畢后24小時(shí)內(nèi)用傳真將空運(yùn)單、發(fā)票和裝箱單發(fā)給買方。

  (13)不可抗力:由于人力不可抗力的'原由,發(fā)生在制造、裝載或運(yùn)輸?shù)倪^(guò)程中導(dǎo)致賣方延期交貨或不能交貨者,賣方可免除責(zé)任。在不可抗力發(fā)生后,賣方須立即電告買方及在14天內(nèi)以空郵方式向買方提供事故發(fā)生的證明文件,在上述情況下,賣方仍須負(fù)責(zé)采取措施盡快發(fā)貨。 Force Majeure: The sellers shall not be held responsible for the delay in shipment or non-deli-very of the goods due to Force Majeure, which might occur during the process of manufacturing or in the course of loading or transit. The sellers shall advise the Buyers immediately of the occurrence mentioned above the within fourteen days there after. The Sellers shall send by airmail to the Buyers for their acceptance certificate of the accident. Under such circumstances the Sellers, however, are still under the obligation to take all necessary measures to hasten the delivery of the goods.

  (14)仲裁:凡有關(guān)執(zhí)行合同所發(fā)生的一切爭(zhēng)議應(yīng)通過(guò)友好協(xié)商解決,如協(xié)商不能解決,則將分歧提交中國(guó)國(guó)際貿(mào)易促進(jìn)委員會(huì)按有關(guān)仲裁程序進(jìn)行仲裁,仲裁將是終局的,雙方均受其約束,仲裁費(fèi)用由敗訴方承擔(dān)。 Arbitration: All disputes in connection with the execution of this Contract shall be settled friendly through negotiation. In case no settlement can be reached, the case then may be submitted for arbitration to the Arbitration Commission of the China Council for the Promotion of International Trade in accordance with the Provisional Rules of Procedure promulgated by the said Arbitration Commission. The Arbitration committee shall be final and binding upon both parties. And the Arbitration fee shall be borne by the losing parties.
